In a bid to bolster responsible gaming initiatives, New Jersey has recently introduced new standards for gambling advertisements and enhanced self-exclusion measures. These measures aim to protect the public from misleading or harmful advertising while providing easier access to support for individuals struggling with gambling addiction.
To gain further insight into the significance of these developments, Gambling.Re spoke with Jeremy Kleiman, Chair of Saiber LLC's Gaming Law Practice and a highly regarded gaming lawyer in the United States. Here, Kleiman shares his assessment and expertise on the newly implemented regulations.
When asked about his assessment of the new gambling ad standards introduced in New Jersey and their effectiveness in addressing concerns related to misleading or harmful advertising, Jeremy Kleiman stated, "The new requirements imposed on gambling operators in New Jersey are a welcome addition to responsible gambling standards. Rather than imposing strict requirements on the content, time, and location of advertising, they provide common-sense policies to ensure an easy way for patrons to opt-out of ads and to ensure advertisers are truthful about the 'risk-free' nature of promotional offers."
Regarding the impact of the new accessible self-exclusion measures, such as the video-conference option and the 24/7 hotline, in assisting individuals with gambling addiction, Kleiman emphasized, "The video-conference option of opting into the self-exclusion list is the most important new tool to assist problem gamblers. The prior requirement of an in-person visit to the regulator to opt-in imposed a deterrent for gamblers who were required to travel and make the effort to attend an in-person meeting. I expect the number of individuals added to the self-exclusion list will increase significantly."
When asked about how he foresees the implementation of these strengthened responsible gaming initiatives impacting the overall gambling landscape in New Jersey, Kleiman expressed his view, "I do not foresee any measurable decrease in gambling revenue, but I do think the new standards will enhance player protections and encourage operators to get creative in continuing to self-regulate advertising and voluntarily add additional responsible gambling measures.”
